Elijah James Holmes, brokered a fuel transaction between Alexandrov Refinery, represented by Mr. Gedasova Maria Nikolavena and Malif General Trading F.Z.E. represented by Richard Baruch.
Mr. Gedasova Maria Nikolavena executed the NCNDA/IMFPA and in so doing agreed to pay Mr. Holmes a fee of $2 million for his services as a broker. When the first transaction concluded, Mr. Nikolavena refused to pay Mr. Holmes his commission. Instead Mr. Nikolavena demanded that Mr. Holmes send him $17,500 to pay for the fee for the NCNDA/IMFPA to be lodged with Mr. Nikolavena's bank.
Thereafter, Mr. Holmes implored the buyer, Mr.Richard Baruch to pay him the commissions due for subsequent lifts of the JP54. However, while this would create a fair and equitable outcome and reverse the fraud caused by Mr. Nikolavena, Mr. Baruch refused to make the adjustment, thereby becoming complicit in the cheating of Mr. Holmes.
